Terms of Service

These terms govern your use of FlyGearExchange. By creating an account or using its marketplace services, you agree to these terms and the marketplace rules. Our Privacy Policy explains how we handle information. Contact the service operator at help@flygearexchange.com.

Who may use the service

You must be at least 18 and legally able to enter into the transactions you arrange. Provide accurate account information, protect your login credentials, and tell us if your account is compromised. You must have authority to act for a business if you use the service on its behalf.

Our role and early access

FlyGearExchange provides tools for independent buyers and sellers to list and transact in aviation equipment. The listed seller is responsible for the item and fulfilling the sale. We are not the owner, manufacturer, inspector, or certifier of listed equipment. Currently, the marketplace is in early access and checkout is not live. Demo listings and test transactions are fictional and create no obligation to deliver an item or pay real money.

Listings and seller responsibilities

The initial marketplace accepts headsets and portable pilot electronics. Sellers must own the item or have permission to sell it, use actual-item photos, accurately describe condition and included accessories, disclose known defects and uncertainty, and comply with the photo-code and testing requirements. Do not list stolen, counterfeit, recalled, prohibited, or airworthiness-critical items. No aircraft or training services.

Sellers are responsible for their listing claims, lawful sales, agreed shipping or pickup arrangements, and applicable tax obligations. Do not change an agreed sale after checkout or substitute an item. Any return conditions must be disclosed before purchase and cannot override applicable law or misrepresent an item’s condition.

Buyer responsibilities

Review the listing and ask the seller about compatibility and condition before purchasing. Supply accurate delivery details and confirm receipt only after receiving the item. Do not make false claims, abuse payment disputes, or substitute items in a return. Manufacturer guidance and qualified professional advice should be used where needed; a listing is not approval to install or operate aviation equipment.

Payments and fees

When checkout is enabled, payments are processed through Stripe on the seller’s connected account. Sellers must complete Stripe onboarding and comply with the applicable Stripe agreements. Any platform fee and buyer total will be disclosed before the transaction is submitted. Stripe processing charges and payout availability depend on the seller’s Stripe arrangement.

FlyGearExchange does not hold funds until delivery or inspection and does not provide escrow, insurance, or guaranteed buyer protection. Delivery confirmation does not control Stripe’s payout timing. A payment may be subject to provider verification, reversal, refund, or dispute handling.

Returns, refunds, and disputes

Contact the seller promptly through your order conversation about a problem and retain photos, packaging, tracking, and messages. Agree on return instructions before shipping anything back. Sellers can initiate supported refunds through the service when payments are connected. There is no automatic change-of-mind return entitlement created by these terms; applicable law and the seller’s disclosed commitments still apply.

Support may review evidence and take marketplace action, but a report does not automatically refund an order or decide a payment dispute. Your rights under applicable consumer law and payment-provider rules are not waived. Do not use off-platform payment requests to evade safeguards or mislead another member.

Verification and reviews

Email confirmation demonstrates access to an inbox. A payment-ready badge describes payment setup. A reviewed listing photo is not a physical inspection. An optional identity result describes a provider check, not a guarantee of honesty, ownership, qualifications, compatibility, or authenticity. Test verification never counts as a real check. Reviews must reflect an actual eligible transaction and must not be fabricated or manipulated.

Your content and acceptable use

You retain ownership of your content and grant FlyGearExchange a nonexclusive license to store, display, reproduce, and process it as needed to operate the service, preserve transaction records, and handle support or moderation. Only upload material you have the right to use. This license does not make private messages public or grant permission to use them in advertising.

Do not harass others, post unlawful content, impersonate someone, publish private information without authorization, distribute malware, bypass access controls, manipulate reviews, or interfere with the service. Report suspected rights violations to support with the relevant listing or content link and an explanation.

Moderation and account closure

We may review, remove, or restrict content and accounts for rule violations, fraud concerns, security, or legal requirements. You may request review through Account or support. Restricted members retain existing order and conversation access where available to resolve transactions. Closing or restricting an account does not erase outstanding sale obligations, payment disputes, or records we must retain.

Availability and limits

We aim to provide a useful service but do not promise uninterrupted availability, error-free information, sales, or particular transaction outcomes. To the extent permitted by law, the service is provided as available without additional warranties. We are not responsible for a seller’s item or a member’s independent representations merely because they appear on the platform. Nothing in these terms excludes liability or rights that cannot lawfully be excluded, including applicable consumer protections.

Changes and questions

We may update these terms as the service develops, identify changes with a new effective date, and provide additional notice or request acceptance where required. Changes do not retroactively alter an agreed purchase. For service concerns, start with Help & support. These terms do not impose mandatory arbitration or waive rights to pursue available legal remedies.
